Formerly called Appendix A of the Investigations Operations Manual (IOM), this status list provides up-to-date information on color additives and allows you to identify the status and limitations of most color additives that may be found in a food, drug, appliance, or cosmetic establishment.
For the sake of brevity, this list is limited in a number of ways in terms of certifications, regulations, labeling, etc. and the Federal Food, Drug, and Cosmetic Act, as amended, Sections 601(e), 602(e), 706, [21 U.S.C. 361(e), 362(e), 376] and with respect to sections 201(s)(3) and (t), 402(c), 403(m), 501(a) and 502(m) [ 21 USC 321(s)(3) and (t), 342(c), 343(m), 351(a) and 352(m)].
Any color additives not on this list that are owned by manufacturers or processors where they may be used in foods, drugs, appliances, or cosmetics should be forwarded to your district for review. Your color analysis service lab is also a good source.
PAINTS: Colored top coats are provisionally listed under 21 CFR 81.1. Part 82 of 21 CFR explains how paints can be made and named, and lists color additives that can be used to make paints. All lakes require certification.
Examples of lake naming:
- A lake's name is composed of the name of the color suffix combined with the name of the base tribe and the word "lake". For example, the name of the pond made by extending FD&C Blue #1 aluminum salt over alumina would be FD&C Blue #1 - Aluminum Pond.
- When a paint is made by applying an FD&C color additive to a substrate other than alumina, the "FD&C" symbol is replaced with "D&C". For example, the name of the pond created by applying FD&C Blue No. 1 on a substrate other than alumina would be D&C Blue No. 1- Aluminum lake.
NOTE: Your attention is drawn to the fact that this appendix is compressed and is intended to be used for review and guidance only. If you are faced with situations involving potential violations of color additive regulations, please check the most recent background document as indicated in the second paragraph of this foreword. Make sure the status is complete and report the facts. It is the district's responsibility to take appropriate action, not yours. Don't advise companies to destroy stocks of suspect goods or initiate recalls without county approval.
